{"id":15362,"date":"2021-09-22T19:26:35","date_gmt":"2021-09-23T02:26:35","guid":{"rendered":"https:\/\/rtcwp.test.19j.5uweb.site\/?p=15362"},"modified":"2021-09-22T19:29:10","modified_gmt":"2021-09-23T02:29:10","slug":"blog-2-4","status":"publish","type":"post","link":"https:\/\/roadtocanada.ca\/en\/blog-2-4\/","title":{"rendered":"Can spousal work permit holder apply for immigration"},"content":{"rendered":"<h2 class=\"wp-block-heading\"><strong>What is a Canadian Spousal Work Permit?<\/strong><\/h2>\n\n\n\n<p>In the Canadian immigration system, the type of work permits include employer-specific work permit and open work permit, and spousal work permit is a kind of open work permit.<\/p>\n\n\n\n<p>According to the Immigration Act, spouses of the following people in Canada may apply for open work permits:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Spouses in Spousal Sponsorship application<\/li><li>Spouses of applicants in the Canadian Immigration Pilot Programs<\/li><li>Spouses of applicants who are applying for refugee or protected person in Canada<\/li><li>Spouses of international students or foreign workers with valid permits in Canada<\/li><\/ul>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Can a spousal work permit holder apply for immigration?<\/strong><\/h2>\n\n\n\n<p>The answer is: It depends on the program.<\/p>\n\n\n\n<p>We will explain the role of spousal work permit in each of the following major immigration programs.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1.<strong>Federal Express Entry<\/strong><\/h3>\n\n\n\n<p>Spousal work permit holders can be the principal applicant of the program or as a spouse adding points to the principal applicant in CRS system.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. <strong>British Columbia Provincial Nominee Program (BCPNP)<\/strong><\/h3>\n\n\n\n<p>BCPNP does not have restrictions on type of work permit, which means that spousal work permit holders can apply for BCPNP.<\/p>\n\n\n\n<p><strong>BCPNP SI &#8211; Skilled Worker Category<\/strong>, <strong>EEBC &#8211; Skilled Worker Category<\/strong>, and <strong>SI &#8211; Entry Level &amp; Semi-Skilled Category<\/strong> are open to spousal work permit holders.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><a href=\"https:\/\/www.alberta.ca\/ainp.aspx\"><\/a>3. Alberta Immigrant Nominee Program (AINP)<\/strong><\/h3>\n\n\n\n<p>AINP clearly states that it does not nominate spousal work permit holders.<\/p>\n\n\n\n<p>Valid work permits are based on one of the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>a positive LMIA<\/li><li>a LMIA exemption for workers based on one of the following exemptions as determine by IRCC:<ul><li>international trade agreements<\/li><\/ul><ul><li>workers transferred within a company<\/li><\/ul><ul><li>International Experience Canada<\/li><\/ul><ul><li>Mobilit\u00e9 Francophone<\/li><\/ul><ul><li>an open work permit issued by IRCC to vulnerable workers who have demonstrated they are experiencing abuse or are at risk of abuse in the context of their employment in Canada or the family members of a vulnerable worker under the VWOWP exemption<\/li><\/ul><\/li><li>a PGWP held by a graduate of an Alberta Advanced Education\u00a0publicly funded post-secondary institution who also meet specific occupation, education and work experience requirements as set out below<\/li><li>an open work permit issued under\u00a0IRCC\u2019s open work permit public policy for former or current PGWP holders\u00a0held by a graduate of an Alberta Advanced Education\u00a0publicly funded post-secondary institution who meet the same specific occupation, education and work experience requirements as PGWP holders as set out below<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">4. <strong>Saskatchewan Immigrant Nominee Program (SINP)<\/strong><\/h3>\n\n\n\n<p>SINP clearly states that it does not nominate spousal work permit holders.<\/p>\n\n\n\n<p>Valid work permits must be from one of the following programs:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Seasonal Agriculture Worker Program.<\/li><li>International Experience Canada.<\/li><li>Temporary Foreign Worker Program.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">4. <strong>Manitoba Provincial Nominee Program&nbsp;(MPNP)&nbsp;<\/strong><\/h3>\n\n\n\n<p>MPNP does not have restrictions on type of work permit, which means that spousal work permit holders can apply for MPN<a>P.<\/a><\/p>\n\n\n\n<p><strong>MPNP Skilled Worker Stream &#8211; Skilled Workers in Manitoba Category<\/strong> is open to spousal work permit holders.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5. <strong>Ontario Immigrant Nominee Program (OINP)<\/strong><\/h3>\n\n\n\n<p>OINP does not have restrictions on type of work permit, which means that spousal work permit holders can apply for OINP.<\/p>\n\n\n\n<p><strong>OINP&nbsp;Employer Job Offer: In-Demand Skills stream<\/strong>, <strong>Ontario\u2019s Express Entry<\/strong><strong> Skilled Trades stream<\/strong>, and <strong>Ontario\u2019s Express Entry Human Capital Priorities stream<\/strong> are all open to spousal work permit holders.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6. <strong>Yukon Nominee Program (YNP)<\/strong><\/h3>\n\n\n\n<p>YNP does not have restrictions on type of work permit, which means that spousal work permit holders can apply for YNP.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Critical Impact Worker criteria <\/strong>and <strong>Skilled Worker criteria <\/strong>are open to spousal work permit holders.<\/h4>\n\n\n\n<h3 class=\"wp-block-heading\">7. <strong>Nova Scotia Nominee Program&nbsp;(NSNP)&nbsp;<\/strong><\/h3>\n\n\n\n<p>NSNP does not have restrictions on type of work permit, which means that spousal work permit holders can apply for NSNP.<\/p>\n\n\n\n<p><strong>Skilled Worker Stream<\/strong>, <strong>Nova Scotia Experience: Express Entry<\/strong>, <strong>Occupations in Demand Stream<\/strong> are open to spousal work permit holders.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>8<\/strong>. <strong>New Brunswick Provincial Nominee Program (NBPNP)<\/strong><\/h3>\n\n\n\n<p>NBPNP does not have restrictions on type of work permit, which means that spousal work permit holders can apply for NBPNP.<\/p>\n\n\n\n<p><strong>Skilled Worker Stream<\/strong>, <strong>Strategic Initiative Stream<\/strong>, and <strong>Express Entry Stream<\/strong> are open to spousal work permit holders.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">9. <strong>Prince Edward Island Provincial Nominee Program (PEI PNP)<\/strong><\/h3>\n\n\n\n<p>PEI PNP does not have restrictions on type of work permit, which means that spousal work permit holders can apply for PEI PNP.<\/p>\n\n\n\n<p><strong>Skilled Worker Stream<\/strong> and <strong>Critical Worker Stream (NOC D)<\/strong> are open to spousal work permit holders.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">10. <strong>Newfoundland and Labrador Provincial Nominee Program (NLPNP)<\/strong><\/h3>\n\n\n\n<p>NLPNP does not have restrictions on type of work permit, which means that spousal work permit holders can apply for NLPNP.<\/p>\n\n\n\n<p><strong>Skilled Worker Category <\/strong>and <strong>Express Entry Skilled Worker<\/strong> <strong>Category <\/strong>are open to spousal work permit holders.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">11. <strong>Northwest Territories Nominee Program&nbsp;(NTNP)&nbsp;<\/strong><\/h3>\n\n\n\n<p>NLPNP does not have restrictions on type of work permit, which means that spousal work permit holders can apply for NTNP.<\/p>\n\n\n\n<p><strong>Employer-Driven Stream &#8211;<\/strong> <strong>Skilled Worker Category <\/strong>and <strong>Employer-Driven Stream \u2013 Entry Level\/Semi-skilled Occupations Category <\/strong>are open to spousal work permit holders.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">12. <strong>Atlantic Immigration Pilot<\/strong><\/h3>\n\n\n\n<p>Spousal work permit holders can accumulate work experience in Canada and apply for <strong>Atlantic High-Skilled Program <\/strong>and <strong>Atlantic Intermediate-Skilled Program<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">13. <strong>Rural and Northern Immigration Pilot<\/strong><\/h3>\n\n\n\n<p>Spousal work permit holders can accumulate work experience in Canada and apply for the either program.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>14.
